Exercise their right to data portability: in such cases, we will create a secure, restricted-access Google Drive folder containing the requested information in a structured, commonly used, machine-readable format
5. Data Transfers Outside Quebec
We use third-party platforms whose servers are located outside Quebec, specifically in the United States, including:
Zoho Sign (electronic signatures)
Zoho Invoice (billing and payments)
Zoho CRM (client relationship management)
Zoho Bookings (appointment scheduling)
Google Workspace (professional emails, internal documentation)
Before using these services, we conducted a privacy impact assessment confirming that adequate safeguards are in place, including encryption, access controls, and adherence to international certifications (ISO 27001, SOC 2). All transfers are governed by contractual clauses ensuring the protection of personal information.
6. Data Retention
Unless otherwise required by law, personal information is retained for a maximum of three (3) years following its collection or the end of the contractual relationship. Voice recordings of calls are retained for up to ten (10) years to provide evidence in the event of a dispute or contractual claim. This duration is based on the principle of proportionality and the legitimate purpose of mutual protection.
7. Call Recording
CyberPerformance may record all inbound and outbound telephone calls for quality control, training, and contractual validation purposes. This practice is disclosed through our privacy policy and applies to any individual communicating with us. These recordings are:
Encrypted and stored in a restricted-access system
Retained for a maximum period of ten (10) years
Used solely to validate verbal agreements, establish or exclude liability, or provide evidence in a legal context
Accessible only to authorized personnel or, in some cases, judicial authorities
A withdrawal mechanism is available: any individual may request deletion of their call recording, provided this does not compromise the legitimate purpose of retention. Requests must be sent via email to [email protected] or by mail to the registered address listed in Quebec’s enterprise register (REQ). For legal requests, a strict protocol will be followed, including identity verification and, if necessary, an in-person meeting. Reasonable fees may apply.
